These Terms of Service ("Terms") govern your use of the Happy Hour Map mobile application and the website at happy-hour-map.com (together, the "Service"), operated by Happy Hour Map ("we," "us," or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who Can Use the Service
The Service contains information about alcoholic beverage promotions. You must be of legal drinking age in your jurisdiction (21 or older in the United States) to use the Service. By using the Service you confirm you meet this age requirement. We do not knowingly direct alcohol-related content to anyone under 21.
2. Free Use for Consumers
The Happy Hour Map app is free for consumers. There are no subscriptions, no in-app purchases, no advertisements, and no account required to browse happy hour deals. You may use, search, and save favorites at no charge.
3. Premium Listings for Bar Owners
Bars and restaurants ("Bar Owners") may purchase optional Premium listings. We currently offer:
- House Pour — free, automatic listing during your published happy hour window.
- Top Shelf — $9.99 per month or $99.99 per year. Includes editable listing, verified badge, flash deal broadcasts, and 24/7 visibility.
- Reserve — $19 per month or $179 per year. Includes everything in Top Shelf plus priority placement and a per-ZIP cap of three Reserve listings.
Pricing is in U.S. dollars and may change at our discretion; any change will not affect existing subscriptions until renewal.
4. Promotional Codes
From time to time we may offer promotional codes (such as "EARLY20" — 20% off the first year of Reserve, ending May 31, 2026). Promo codes apply only to the period and tier specified, are not retroactive, and cannot be combined unless explicitly stated. Subscriptions renew at standard pricing after any promotional period ends.
5. Billing and Payment
All Premium subscription billing is processed by Stripe, Inc. Stripe handles your payment information; we do not see or store your full card details. By subscribing you agree to Stripe's Terms in addition to these Terms. Subscriptions auto-renew on the same cadence (monthly or yearly) until cancelled.
6. Cancellation
You may cancel a Premium subscription at any time through your Stripe customer portal or by emailing [email protected]. Cancellation takes effect at the end of your current billing period; you retain Premium features until then. There are no contracts and no cancellation fees.
7. Refunds
We offer pro-rated refunds for unused subscription time on yearly plans if you cancel within the first 30 days. Monthly plans are non-refundable past the day of charge — simply cancel to avoid the next charge. To request a refund, email [email protected] from the email address used at checkout.
8. Reserve Tier ZIP Cap
Reserve listings are capped at three per U.S. ZIP code. If you purchase Reserve and your ZIP is already at capacity at the time of purchase, we will either (a) refund your subscription in full, or (b) downgrade you to Top Shelf and refund the difference, at your choice. The /reserve-check page shows current availability before you subscribe.
9. Bar Owner Responsibilities
If you submit or edit a listing as a Bar Owner, you represent that:
- You are authorized to act on behalf of the bar or restaurant in question.
- The happy hour times, prices, and deal descriptions you submit are accurate and current.
- You will update or remove your listing within a reasonable time if your offer changes or ends.
- You will not submit listings for venues that do not exist, businesses you do not represent, or content that violates the rights of any third party.
We may remove any listing that is inaccurate, misleading, expired, or in violation of these Terms, with or without notice. Repeated violations may result in suspension or termination of your Premium subscription without refund.
10. Flash Deals
Premium tiers include the ability to send "flash deals" — push notifications about time-limited specials to opted-in users in your city. By sending a flash deal you agree that:
- The deal is genuinely available at your venue at the time and on the terms stated in the notification.
- You will not use flash deals for content unrelated to a current promotion at your venue.
- You will not abuse the channel with excessive frequency. We may rate-limit or revoke flash-deal access for any account at our discretion.
11. Listing Data and Sources
The Service aggregates happy hour information from public sources, third-party APIs (including Yelp), community submissions, and direct submissions from Bar Owners. We work to keep the data fresh but make no warranty that any specific listing is current, accurate, or complete. Always confirm prices, hours, and offers directly with the venue before relying on them.
12. User Content
If you submit a listing, correction, or other content to the Service, you grant us a worldwide, royalty-free, non-exclusive license to use, display, and distribute that content in connection with operating and promoting the Service. You retain ownership of your content. You will not submit content that is unlawful, defamatory, infringes others' rights, or violates these Terms.
13. Acceptable Use
You agree not to:
- Use the Service to scrape, mirror, or republish bulk listing data without our written permission.
- Interfere with, probe, or attempt to exploit the Service, our APIs, or our infrastructure.
- Use the Service to harass other users or businesses, or to send spam through any feature.
- Reverse-engineer the app or attempt to circumvent technical limitations.
14. Intellectual Property
The Service, including the "Happy Hour Map" name, logo, and original design, is owned by us and protected by U.S. and international copyright and trademark law. Bar Owners' venue names, logos, and content remain the property of their respective owners and are used here under fair use, license, or with permission.
15. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee that listings are accurate, that the Service will be uninterrupted, or that any specific result (foot traffic, sales, sign-ups) will be achieved by any Premium subscriber. Premium tiers are tools to increase visibility, not a guarantee of business outcomes.
Drink responsibly. We are not responsible for what happens at any venue listed in the Service or for the consequences of consuming alcoholic beverages.
16. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
17. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or any content you submit.
18. Termination
You may stop using the Service at any time. We may suspend or terminate your access — including any Premium subscription — if we reasonably believe you have violated these Terms. If we terminate a paid subscription for cause, no refund is owed. If we discontinue the Service entirely, we will refund any unused prepaid subscription time on a pro-rata basis.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. For active Premium subscribers, we will give at least 14 days' notice of material changes by email before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction in the United States. You and we both waive the right to a jury trial and to participate in any class action arising out of these Terms or the Service.
